1. Introduction
Welcome to Buy To Cover! We're so grateful you're giving our small business an opportunity to join your wardrobe! By shopping with us, you agree to our terms and conditions as described below. Please read them carefully before making a purchase. Customers must be of a legal age in their jurisdiction to make a purchase, or have the consent from a guardian. This page may periodically change, so be sure to review prior to ordering. Agreement to these terms and conditions is required to place an order.

2. Returns and Exchanges
Due to the nature of our dropshipping model, we are unable to accept returns or exchanges related to sizing issues. We strive to provide comprehensive sizing guides and accurate product descriptions to help you make informed decisions. Please review sizing information carefully before purchasing. Some items are known to 'run small' or 'run large'. When we're aware of such items we state it clearly in the description. 

3. Refunds for Quality Issues
We are committed to providing high-quality products. Refunds are only issued for substantial quality issues. If you encounter a quality-related issue, please photograph the defect and submit a support ticket through our website immediately. We will assess the problem and determine if a refund is applicable based on the evidence provided. All quality-based returns must be submitted within (7) calendar days of receipt of the item, as defined by the 'delivered' date on the original order tracking number. Examples of 'substantial quality issues' include:

• Receiving the incorrect color (eg, ordered green, received yellow).
• Receiving an incorrect size that falls outside of the listed variances (eg, ordering a small and receiving a 2XL).
• Defects with the print-on-demand process (material damage to the graphics, text, or embroidery)
• Defects with clothing (rips, tears, or stains)

To report a quality issue, click the "Contact Us" button on any page of the store to open a support ticket. We'll review the evidence provided and provide a formal response and proposed resolution.

4. Color and Material Variation
Minor variations in color and texture may occur. These differences can be due to the printing process and variations between fabrics and dyes. Colors on the screen may not exactly match the product you receive, but we endeavor to ensure that the images are as close as possible to the actual items. These variations are not consider 'defects' and are a normal part of clothing manufacturing. Minor color and material variations do not qualify as a 'quality issue' and are ineligible for returns. 

5. Shipping Locations
Our products are shipped from various locations across the US, Canada, Australia, and Europe. The shipping origins for certain products may be specified in the product descriptions if they ship exclusively from one location. Items shipping exclusively from one location may take longer to deliver based on the destination address. Tracking information and delivery estimates are provided at the point of shipment and provided via an email link to the order status page which includes tracking information once added.

6. Product Sourcing
We are not the original manufacturers of the clothing offered in our store. Where applicable, we disclose the sourcing of 'blanks' or base products used in the final merchandise in the product descriptions so you can make informed purchase decisions.

7. Shipping and Handling Charges
All shipping and handling charges are disclosed at the point of purchase. Please note that these charges are non-refundable, except in the case where we determine that a refund for a product’s quality issue is necessary. Shipping charges are determined from our print-on-demand partner and determine per region shipped. We cannot waive or discount shipping costs, but share them in an effort to be transparent about how they are calculated.

If you buy multiple items, you will be charged the highest 'first product' shipping cost for any shirts, hoodies, and totes and the 'additional product' cost for every shirt, hoodie, or tote in your cart. You can mix and match different designs, colors, and types (short-sleeve and cropped, for example) and all subsequent shirts and hoodies are billed at the 'additional product cost'.

Ceramic mugs and hats added to your cart are always charged the 'first product' shipping cost irrespective of the number of additional products for shirts and hoodies. Subsequent mugs and hats in the same cart are charged the 'additional product' cost.

For example, buying a hoodie, ceramic mug, two t-shirts, a hat, and a tote bag would estimate shipping at $24.47 in the US:

Hoodie - $7.99 First Product +
T-Shirt - $2.00 Additional Product +
2nd T-Shirt - $2.00 Additional Product +
Ceramic Mug - $6.49 First Product +
Tote - $2.00 Additional Product
Hat - $3.99 First Product

Total Shipping: $24.47

The handling fee associated with our products covers various operational aspects essential for ensuring high-quality production and fulfillment of your orders. This fee helps to cover costs related to production, quality assurance, packaging, logistics, and customer support. By including this fee, we ensure that every product you receive meets our high standards and arrives in perfect condition. The handling fee is not ultimately received by Buy To Cover and is instead paid to our print-on-demand partner. The fee is variable depending on product weight and complexity but is generally between $1.30 and $1.50 per item. As additional like items are added the fee is reduced proportionally. We cannot waive or discount this fee.

8. Delivery Times

Products are produced 'on-demand' and are printed at the time of purchase. This means there is a slightly longer fulfillment time than you may be used to with stores that carry active inventory in warehouses. Please use the matrix below to understand the estimated delivery times for items you may purchase with us. We are advised by our print-on-demand partner that these estimates may expand during heavy volume periods through November and December. If you have concerns about delivery time, reach out to us and we can help estimate your delivery time. Please understand we cannot provide refunds based on delivery expectations as we do not have direct control over this process.

Products may ship in partial shipments at the discretion of our logistics partner.

Missing or lost shipments are not common, but can still sometimes happen. If your product has shipped and has not been received within the expected 'delivery time' window, please contact us. Items confirmed lost or missing in tandem with our logistics partner are eligible for refund or reshipment, at the customer's discretion.

9. Use of Promotion or Discount Codes

Buy To Cover reserves the right not to honor any discount code that is issued in error or that would result in Buy To Cover incurring a material loss on a product sale - such as codes that would result in a zero-cost transaction. Buy To Cover may additionally void any discount codes found to be generated without the consent of Buy To Cover or exploited through unauthorized technical means, breach, fraud, misuse, or abuse of Buy To Cover's service providers ("ineligible codes"). In the event an order is determined to be using an ineligible discount code for any reason, the order would be cancelled and any funds returned to the purchaser. Discount codes cannot be stacked with other discounts and may have time-limited terms or redemption limits. Discount codes may expire or be terminated at any point by Buy To Cover without notice. Certain products may not be eligible for discount codes. It is the customer's responsibility to verify that the discount is applied in the shopping cart before completing the purchase. Buy To Cover cannot provide refunds based on discount codes that were not utilized. Follow "BuytocoverLLC" on X to stay informed about new promotion codes. Note that Buy To Cover does not distribute gift cards.

10. Taxes
Buy To Cover is obligated to collect taxes in jurisdictions it is required to. Our "physical nexus" is located in New Jersey, USA. We are required under EU regulations to collect VAT for those who purchase products from a member state of the European Union. Customers are responsible for any additional taxes or duties that may apply in their jurisdiction. 

11. Sustainability

Some products carry sustainable characteristics such as organic cotton or recycled fibers. These are explicitly disclosed in the product descriptions. Please assume that any products that do not explicitly notate these characteristics do not have them. While we aspire to provide sustainable options, we are not the original manufacturer of the fabrics and have no control over the sustainability options major textile manufacturers may provide.

12. We Reserve the Right to Cancel Your Order if We Can't Fulfill

Any orders that cannot be fulfilled for any reason may be cancelled and refunded. By ordering with us, you consent that these events, though rare, could occur. Such reasons may include, but are not limited to:

• Product availability has changed after the order has been placed.
• We experience issues with our print-on-demand vendor, hosting services, or payment processor that impacted our ability to complete the order.
• We experience a clear and obvious mistake in how an item has been priced. We define a 'clear and obvious' mistake whereby a product is listed below our cost to fulfill. 
• Force majeure events such as natural disasters, wars, terrorist attacks, epidemics, civil unrest, labor stoppages, and extreme weather. 

13. No License to Reproduce Original Content

For original works of art and written content, Buy to Cover LLC retains all legal ownership to its intellectual property, including: graphics designs, logos, product descriptions, and use of "Buy to Cover" branding. Images known to be in the public domain or under 'free' licensing models such as Creative Commons are excluded and may be reproduced. Images and branding from select cryptocurrency projects are used with consent from the project and may not be reproduced without consent from the project. Please support our designers by respecting their original ideas. Any unauthorized use of original content may result in potential legal action.

• Our original content is labeled under the "Buy to Cover Originals" and "Vote Crypto" categories and labeled "BTC Originals". 
• Kawakami content is labeled under the "KAWA" category and prefixed with "KAWA" on products. Buy to Cover has received permission from the Kawakami project for use of the Kawakami graphics and text for the purposes of product sales.
• Kounotori content is labeled under the "KTO" category and prefixed with "KTO" on products. Buy to Cover has received permission from the Kounotori project for use of the Kounotori graphics and text for the purposes of product sales.

Labeling or categorization is provided for ease of shopping only and does not impact the underlying ownership of intellectual property.

14. Marketing Partnerships Do Not Imply Endorsement

Buy to Cover, LLC, may have various marketing agreements with cryptocurrency projects with respect to use of project graphics, text, or other intellectual property. Use of these third-party assets is agreed for the purposes of product sales. Buy To Cover, LLC, does not otherwise endorse or guarantee these projects with respect to: a) The ability of the listed project to meet published goals, b) Financial performance of the project, c) Performance of the project's cryptocurrency token, or d) Published statements by the project's founders, managers, investors, or token holders.

15. We May Own Cryptocurrency in Projects We've Partnered With

The operators of Buy To Cover, LLC and/or its designers or team may own a financial interest in the cryptocurrency coins or tokens represented by products on this site. Nothing should be constituted as a solicitation to purchase these assets. Additionally, no content written in the product descriptions or graphical designs on clothing or accesories should serve as financial advice and is presented for entertainment purposely only. Buy To Cover, LLC recommends all parties interested in the underlying cryptocurrency projects to seek qualified financial advice and review all applicable local, state, or national laws with respect to transacting in said projects.

17. Legal Jurisdiction

These terms and conditions are governed by and construed in accordance with the laws of the State of New Jersey, USA. By using our website and making purchases, you agree to submit to the jurisdiction of the courts located in New Jersey for any disputes arising out of or relating to these terms and conditions.

18. Limitation of Liability

To the fullest extent permitted by law, Buy To Cover LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

• Your use or inability to use our services.
• Any unauthorized access to or use of our servers and/or any personal information stored therein.
• Any interruption or cessation of transmission to or from our services.
• Any bugs, viruses, trojan horses, or the like that may be transmitted to or through our services by any third party.
• Any errors or omissions in any content or for any loss or damage incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available through our services.

Notwithstanding the foregoing, the maximum value Buy To Cover, LLC would be liable for under any theory of liability is the total value of the order and any applicable shipping charges.

19. Severability

If any provision of these terms and conditions is found to be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these terms and conditions and shall not affect the validity and enforceability of any remaining provisions.

20. Dispute Arbitration 
Any dispute, claim, or controversy arising out of or relating to these terms and conditions, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by arbitration in New Jersey, USA, before a single arbitrator. The arbitration shall be administered by the American Arbitration Association (AAA) pursuant to its Consumer Arbitration Rules. Judgment on the award may be entered in any court having jurisdiction.

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. If for any reason a claim proceeds in court rather than in arbitration, we each waive any right to a jury trial. This arbitration agreement does not preclude you from seeking actions in small claims court for disputes or claims within the scope of small claims jurisdiction. 

You understand and agree that, by entering into these terms and conditions, you and Buy To Cover LLC are each waiving the right to a trial by jury or to participate in a class action. 21. Amendments

Buy To Cover LLC reserves the right to amend these terms and conditions at any time. We will notify you of any changes by posting the new terms and conditions on our website. It is your responsibility to review these terms and conditions periodically. Your continued use of our website following the posting of changes constitutes your acceptance of such changes.
